FMCSA Clarifies English Language Exemptions
On October 16, 2026, the Commercial Vehicle Safety Alliance (CVSA) reported an important clarification from the Federal Motor Carrier Safety Administration (FMCSA) about English Language Proficiency (ELP) enforcement.
FMCSA clarified that its special roadside English language enforcement procedures do not apply to drivers who are fully exempt from the relevant requirements of 49 CFR Part 391.
Certain agricultural operations, including qualifying farm transportation, beekeeping, and harvesting operations, may fall under these exemptions.
The clarification was issued by FMCSA on October 6, 2026.
What This Means for CDL Drivers
Not every agricultural truck driver qualifies for an exemption.
Drivers must meet the conditions of a specific federal exemption. Drivers who are not exempt remain subject to English language requirements.
