FMCSA Receives Petition to Regulate Broker Agents

On October 13, 2026, the Federal Motor Carrier Safety Administration (FMCSA) received a petition from Enterprise Auto Transport proposing new federal requirements for freight brokerage sales agents.
The petition asks FMCSA to establish registration, identity verification, training, and oversight requirements for people who arrange transportation services on behalf of brokers.
The goal is to prevent unauthorized brokerage activities, misrepresentation, and consumer fraud.
FMCSA listed the petition under 49 CFR Part 371, which regulates property brokers.
The proposal is still under review. No new regulations have been adopted.
What This Means for CDL Drivers
Truck drivers, car haulers, and owner-operators often work with freight brokers and their agents to find loads.
If the proposal is adopted, new verification and registration requirements could make it easier for carriers to identify legitimate brokerage agents and avoid fraudulent transactions.
