FMCSA Proposes Two Pilot Programs to Test More Flexible HOS Rules

The Federal Motor Carrier Safety Administration (FMCSA) published two notices on October 6 and 7, 2026, outlining pilot programs that could give truck drivers more flexibility with hours-of-service (HOS) regulations.

The first program would allow participating drivers to pause their 14-hour driving window for up to three hours. The pause could include off-duty time, sleeper berth time, or time spent waiting during loading and unloading.

The second program would test new sleeper berth split options, including 6/4 and 5/5 hours. Current federal rules generally allow 7/3 and 8/2 splits.

FMCSA plans to study approximately 256 drivers in each program to evaluate fatigue, safety, and working conditions. The rules have not changed for regular CDL drivers. Public comments are open until December 7, 2026.
