FMCSA Expands Fuel Hauler HOS Waiver

By CDLCrewEditorial standards

More fuel truck drivers can now use special HOS rules.

On October 15, 2026, FMCSA amended its temporary Hours of Service waiver for fuel transportation.

The waiver already covered gasoline and diesel. Now it also includes ethanol and denatured ethanol.

Heating oil is also covered in certain mixed loads, but it cannot make up more than 75% of the shipment.

Eligible drivers may drive up to 16 hours in a 24-hour period.

They must take at least six consecutive hours of rest in a sleeper berth, or eight consecutive hours off duty if the truck has no sleeper.

Drivers must carry a copy of the waiver and meet all CDL and endorsement requirements.

The waiver expires December 16, 2026.

What This Means for CDL Drivers

This change gives eligible fuel tanker drivers more flexibility.

It does not apply to regular dry van, reefer, or flatbed freight.
